SEARCY COUNTY, AR – Searcy County Sheriff Kenny Cassell will remain in office, FOX16 has learned.
According to Cassell’s attorney, Joe Don Winningham, Special Judge Klinger dismissed the state’s case to remove Cassell from office Thursday afternoon.
In 2011, Prosecutor Cody Hiland
filed papers to remove Cassell from office because of a misdemeanor conviction in 1979 for
knowingly possessing stolen Cornish hens.
Hildand tells Fox 16 that he respectfully disagrees with the judge and believes the judge added a condition that is not currently in case law. Hiland says he needs clarification from the Supreme Court relative to this issue.
